Introduction

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and LIU SONGSONG ("Operator", "we", "us", or "our"), the operator of HelloVideo (accessible at https://hellovideo.com). These Terms govern your access to and use of the HelloVideo platform, including all features, functionalities, and services offered through the platform (collectively, the "Service").

By creating an account, accessing, or using HelloVideo, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.

Definitions

The following terms have the meanings set forth below when used in these Terms:

• "Service": The HelloVideo platform, including the website, AI image and video generation features, user dashboard, credit system, and all related functionalities accessible at https://hellovideo.com
• "Credits": Virtual units used to access AI image and video generation features on HelloVideo. Credits have no cash value and cannot be transferred, sold, or exchanged
• "Content": Any text, images, videos, data, or other materials submitted, generated, or displayed through the Service
• "AI-Generated Content": Images and videos produced by the Nano Banana and Seedance series AI models operated by third-party AI model providers, created in response to User-submitted prompts or reference images
• "User": Any individual who creates an account and accesses or uses the Service
• "Subscription": A recurring paid plan (Pro Monthly, Pro Annual, Ultra Monthly, or Ultra Annual) that provides a monthly allocation of Credits and access to premium features
• "Credit Package": A one-time purchase of Credits that provides immediate access to a fixed number of Credits
• "Nano Banana Series": The AI image generation models (Nano Banana, Nano Banana 2, and Nano Banana Pro) provided by third-party AI model providers, and the Seedance series for video generation, used by HelloVideo to generate images and videos from text prompts and reference images
• "Free Plan": The default plan providing limited monthly Credits at no cost

Account Registration

Creating an Account

To use HelloVideo, you must create an account. During registration, you agree to:

1. Provide accurate and complete information: Including your real name and a valid email address
2. Verify your email address: We send a verification email upon registration via Resend; you must confirm your email before accessing certain features
3. Maintain the security of your account: You are responsible for all activities that occur under your account and must not share your password with any third party
4. Be at least 13 years old: Users under 18 must have parental or guardian consent to use the Service
5. Not create multiple accounts: Each individual is limited to one account; creating multiple accounts for the purpose of obtaining free Credits is prohibited

Authentication Methods

HelloVideo supports the following authentication methods via Better Auth:

• Email and password: With mandatory email verification
• Google OAuth: Sign in using your Google account
• GitHub OAuth: Sign in using your GitHub account

You are responsible for maintaining the confidentiality of your authentication credentials and for all actions taken under your account. If you suspect unauthorized access to your account, you must notify us immediately at support@hellovideo.com.

Account Verification

We reserve the right to verify your identity and account information at any time. We may suspend or terminate accounts that contain false, inaccurate, or misleading information.

Credits and Subscription

How Credits Work

Credits are the virtual currency used to access AI image and video generation features on HelloVideo. Each image generation action consumes a specific number of Credits based on the generation parameters:

• Text-to-image generation: Consumes Credits per image generated
• Image-to-image generation: Consumes Credits per image generated (may require more Credits than text-to-image)
• Batch generation: Consumes Credits for each image in the batch
• Re-generation: Each new generation (including retries) consumes Credits

Credit Allocation Methods

Credits are allocated to your account through the following methods:

Credit Expiration and Consumption

Credits are subject to the following rules:

1. 30-day expiration: Credits allocated through monthly refresh or subscription expire 30 days after allocation if unused
2. Credit Package Credits: Credits purchased through Credit Packages expire 30 days after purchase if unused and are consumed after all subscription/expiring Credits
3. FIFO consumption: When you use Credits for image or video generation, the system consumes Credits in First In, First Out (FIFO) order, prioritizing Credits closest to their expiration date
4. No cash value: Credits have no monetary value, cannot be converted to cash, and cannot be transferred between accounts
5. No stacking of monthly Credits: Monthly allocation replaces (does not add to) any remaining monthly Credits from the previous period for the same allocation type

AI Image & Video Generation

How It Works

HelloVideo uses the Nano Banana series of models (for images) and Seedance series (for videos), provided by third-party AI model providers, to generate images and videos. The process works as follows:

1. You submit a text prompt describing the desired image or video, or upload a reference image for image-to-image generation
2. Your prompt and/or reference image are transmitted to our AI model providers for processing by our AI models
3. The model generates one or more images or videos based on your input
4. Generated images and videos are stored in Cloudflare R2 and displayed in your dashboard
5. The appropriate number of Credits is deducted from your account

User Responsibility

You are solely responsible for:

• The content of your text prompts and reference images
• Ensuring that your prompts do not request or result in prohibited content
• The use and distribution of AI-generated images you download or share
• Understanding that AI-generated images may not be protected by copyright in all jurisdictions
• Verifying that generated images do not infringe on any third-party rights before commercial use

Prohibited Content

You must not use HelloVideo to generate, attempt to generate, or facilitate the generation of any of the following types of content:

1. Illegal content: Any content that violates applicable local, national, or international laws
2. Copyrighted characters: Images of copyrighted characters, trademarks, or protected intellectual property without authorization from the rights holder
3. Child Sexual Abuse Material (CSAM): Any content depicting or related to the sexual exploitation of minors, including but not limited to AI-generated depictions
4. Non-consensual intimate depictions: Any intimate or sexual content depicting real individuals without their explicit consent, including AI-generated "deepfakes"
5. Extreme violence or gore: Gratuitously violent, gory, or disturbing content that serves no legitimate artistic or educational purpose
6. Hate speech: Content that promotes hatred, discrimination, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
7. Misinformation and deception: Content designed to spread false information, create misleading "deepfakes," or deceive others in harmful ways
8. Terrorism and extremist content: Content that promotes or supports terrorist organizations or extremist ideologies
9. Harassment and bullying: Content intended to harass, intimidate, bully, or stalk specific individuals
10. NSFW and sexually explicit content: Any nudity, sexually explicit, or sexually suggestive content, including but not limited to AI-generated NSFW imagery, undressing simulations, and provocative poses with sexual intent. Our AI models are configured to automatically refuse such requests

Enforcement and Right to Refuse

We reserve the right to:

• Refuse to process any prompt or generate any image at our sole discretion
• Implement automated content filtering systems to detect and block prohibited content
• Review flagged prompts and generated images for policy compliance
• Suspend or terminate accounts that repeatedly attempt to generate prohibited content
• Report illegal content to relevant law enforcement authorities when required by law
• Modify our content policies at any time to address emerging concerns
• Our Nano Banana series AI models have built-in NSFW content filters that automatically reject prompts requesting prohibited content

Payment and Billing

Pricing

All prices are displayed in US Dollars (USD). Current pricing is as follows:

Subscriptions:

• Pro Monthly: $19.90/month
• Pro Annual: $178.80/year
• Ultra Monthly: $39.90/month
• Ultra Annual: $358.80/year

One-Time Purchases:

• Credit Packages: $9.90 to $69.90

Payment Processing

All payments are processed by our third-party payment processor:

• Creem: Acts as Merchant of Record (MoR), processing all payments including subscriptions and credit packages while handling global tax compliance

We do not directly collect, store, or process your credit card information. All sensitive payment data is handled by our payment processors in compliance with PCI-DSS standards.

Auto-Renewal

• Monthly subscriptions automatically renew at the end of each billing period (every 30 days) unless you cancel before the renewal date
• Annual subscriptions automatically renew at the end of each billing period (every 12 months) unless you cancel before the renewal date
• Credit Packages are one-time purchases and do not auto-renew

Price Changes

We reserve the right to change our pricing at any time. For price increases:

• We will provide at least 30 days' advance notice via email to the address associated with your account
• The new price will take effect at the start of your next billing cycle after the notice period
• If you do not agree with the new price, you may cancel your subscription before the new price takes effect
• Price changes do not affect previously purchased Credit Packages

Billing Errors

If you believe you have been charged incorrectly, please contact us at support@hellovideo.com as soon as possible. We will investigate and correct any verified billing errors promptly.

Refund Policy

Our refund policy varies by purchase type. Please read carefully:

Subscription Refunds

You may request a full refund for a subscription purchase only if all of the following conditions are met:

1. The Credits allocated under the subscription are completely unused — this means there are zero USAGE transactions in your credit transaction history since the most recent subscription Credit allocation
2. The refund request is submitted within 30 days of the subscription charge
3. The account is in good standing and has not been flagged for Terms of Service violations

No refund will be issued if any Credits from the subscription have been used, even a single Credit. Usage includes but is not limited to:

• Text-to-image generation
• Image-to-image generation
• Batch generation
• Re-generation or retry of any image
• Text-to-video generation
• Image-to-video generation

We verify Credit usage through our transaction records. Each USAGE transaction in your credit history indicates that Credits have been consumed for image or video generation.

Credit Package Refunds

Credit Packages are non-refundable. Upon purchase, Credits are immediately activated and available for use. Because Credits can be used immediately upon purchase, we cannot offer refunds for Credit Package purchases.

How to Request a Refund

To request a subscription refund:

1. Send an email to support@hellovideo.com with the subject line "Refund Request"
2. Include your registered email address and the reason for the request
3. We will verify your Credit usage through our transaction history
4. If approved, the refund will be processed within 5 business days to the original payment method
5. The timing of the refund appearing on your statement depends on your payment provider's processing time

After a Refund

If your refund request is approved:

1. Your subscription will be cancelled immediately
2. All Credits in your account will be zeroed out
3. Previously generated images will remain accessible in your account
4. Your account will revert to the Free Plan
5. You may resubscribe at any time

Intellectual Property

Ownership of AI-Generated Content

You retain ownership and all rights to the AI-generated images and videos you create using HelloVideo, subject to the following:

1. You have the right to use, reproduce, distribute, and create derivative works from your generated images and videos
2. You acknowledge that AI-generated content may have limited copyright protection in certain jurisdictions
3. You are responsible for ensuring that your use of generated content does not infringe on any third-party rights
4. We do not claim ownership of your generated content

License to HelloVideo

By using the Service, you grant HelloVideo a limited, non-exclusive license to:

1. Process your prompts and generate images and videos as part of providing the Service
2. Store generated images and videos in Cloudflare R2 for delivery to your account
3. Display images and videos to you within your authenticated account dashboard

This license exists solely for the purpose of providing the Service and does not include the right to use your images or videos for marketing, model training, or any other purpose without your explicit consent.

HelloVideo Intellectual Property

The HelloVideo platform, including its website design, user interface, logo, branding, and underlying software (excluding the Nano Banana series models), is the intellectual property of LIU SONGSONG and is protected by applicable intellectual property laws.

Nano Banana Series Models

The Nano Banana series AI models are developed and operated by third-party AI model providers. HelloVideo is a licensed user of these models and does not claim ownership of the models, their algorithms, or their underlying technology.

AI Model Disclosure

HelloVideo is an independent product and is not affiliated with, endorsed by, or sponsored by any AI model providers. We provide access to the Nano Banana series of models (Nano Banana, Nano Banana 2, and Nano Banana Pro) through our custom interface to enhance usability and provide additional features. HelloVideo does not own or develop the underlying AI models.

User Conduct

By using HelloVideo, you agree to comply with the following rules of conduct. You must not:

Illegal and Harmful Activities

• Use the Service for any purpose that violates any applicable local, national, or international law or regulation
• Generate content that infringes on the intellectual property rights of others
• Attempt to generate CSAM, non-consensual intimate imagery, or other illegal content
• Use the Service to harass, threaten, or intimidate others

Account Security

• Share your account credentials with any third party
• Create multiple accounts to abuse free Credits or promotional offers
• Attempt to gain unauthorized access to other users' accounts or our systems
• Use automated tools, bots, or scripts to access the Service without our authorization

Service Integrity

• Attempt to reverse engineer, decompile, disassemble, or otherwise analyze the Nano Banana series models or any component of the Service
• Circumvent, disable, or interfere with any security features, content filters, or usage restrictions
• Attempt to exploit any bugs, glitches, or vulnerabilities in the Service for personal gain
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Use the Service in any manner that could damage, disable, overburden, or impair our servers or networks

Fair Use

• Use Credits obtained through fraudulent means
• Attempt to manipulate the credit system or subscription billing
• Resell or redistribute Credits or account access

Service Availability

As-Is Service

HelloVideo is provided on an "as is" and "as available" basis. We do not guarantee that:

• The Service will be available at all times or without interruption
• The Service will be error-free, secure, or free from bugs or viruses
• The results obtained from using the Service (including AI-generated content) will be accurate, reliable, or meet your expectations
• Any errors or defects in the Service will be corrected

Service Modifications

We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time, including features, Credit pricing, and subscription plans
• Impose limits on certain features or restrict access to parts of the Service
• Change the AI models or processing methods used for image and video generation
• Modify the number of Credits required for specific generation tasks

Maintenance and Downtime

We may perform scheduled or emergency maintenance that temporarily affects Service availability. We will make reasonable efforts to provide advance notice of scheduled maintenance when possible.

Termination

Termination by Us

We may suspend or terminate your account and access to the Service, without prior notice or liability, under the following circumstances:

1. Terms of Service violations: Any violation of these Terms, including attempting to generate prohibited content
2. Fraudulent activity: Suspected fraud, abuse, or illegal activity associated with your account
3. Account inactivity: Accounts that have been inactive for more than 12 consecutive months may be deactivated
4. Chargebacks: If you initiate a chargeback with your payment provider without first contacting us to resolve the issue

Termination by You

You may terminate your account at any time by:

1. Cancelling your subscription through your account settings or by contacting us at support@hellovideo.com
2. Requesting account deletion through your account settings or by email

Effects of Termination

Upon termination of your account, regardless of the reason:

1. Credits forfeited: All remaining Credits in your account will be permanently forfeited with no compensation
2. Subscription cancelled: Any active subscription will be cancelled immediately
3. Content retained temporarily: Your previously generated content will be retained for 30 days after termination, after which they will be permanently deleted from Cloudflare R2
4. No refund: Terminated accounts are not eligible for refunds unless the termination qualifies under our Refund Policy
5. Billing records retained: We will retain billing and transaction records as required by applicable law

Limitation of Liability

Disclaimer of Warranties

To the fullest extent permitted by applicable law, HelloVideo disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Damages

In no event shall LIU SONGSONG, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to or use of our servers or any personal information stored therein
• Damages resulting from any errors, mistakes, inaccuracies, or omissions in any content generated by the Service
• Damages resulting from the inability to use the Service

Maximum Liability

In no event shall our total aggregate liability to you exceed the total amount paid by you to HelloVideo during the 12 months preceding the event giving rise to the liability.

Assumption of Risk

You acknowledge and agree that:

• AI-generated content may not always produce the desired results
• The quality, accuracy, and appropriateness of generated content depend on the prompts you provide
• You bear full responsibility for the use and distribution of generated content
• The Service may experience interruptions, errors, or delays

Indemnification

You agree to indemnify, defend, and hold harmless LIU SONGSONG, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, actions, demands, liabilities, and settlements including legal fees arising from:

1. Your violation of these Terms of Service
2. Your use of the Service in any manner that violates applicable laws
3. Your generation or distribution of content that infringes on third-party rights
4. Any content you create using the Service that causes harm to others

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which LIU SONGSONG is located at 10 Xiyuan Road, Sandun Town, Xihu District, Hangzhou, Zhejiang 310030, China, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved in the competent courts of 10 Xiyuan Road, Sandun Town, Xihu District, Hangzhou, Zhejiang 310030, China, and you consent to the personal jurisdiction and venue of such courts.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

1. We will provide at least 30 days' advance notice via email to the address associated with your account for material changes
2. The updated Terms will be posted on this page with a revised date
3. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms
4. If you do not agree with the revised Terms, you must stop using the Service and may request account deletion
5. Changes to the Refund Policy will apply prospectively only and will not affect purchases made before the change

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced by a valid provision that most closely reflects the intent of the original provision.

Entire Agreement

These Terms of Service, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and LIU SONGSONG regarding your use of HelloVideo and supersede any prior agreements or understandings.
